先祖名義のままになっている土地がある。
問題点
相続が発生する都度名義を変更しなければいけないという法律はありませんが、このままでは相続財産が確定しないままの状態になってしまいます。
また、時間の経過とともに相続人が増え、かつ相続人同士の関係も希薄化していくため、
相続登記を先延ばしにすればするほど、手続きは複雑になり難航します。
生前対策
まずは、名義変更をしましょう。相続登記を先延ばしにすることは、問題を複雑化してしまうだけです。もし、相続人のなかに、高齢者などで判断能力を欠いている方がいる場合、法定後見等が必要になってきます。家庭裁判所に申し立てるため、時間に余裕を持ったほうが良いでしょう。
